These Terms & Conditions ("Terms") govern your access to and use of the Aman mobile application, the Aman website at myamanapp.com, and any related services, features, and content (together, the "Platform" or "Service"), operated by Aman App ("Aman", "we", "us", or "our"). Please read these Terms carefully before using the Platform. By accessing or using the Platform, you agree to be bound by these Terms.
By downloading, installing, accessing, browsing, registering for, or otherwise using the Platform in any way, you acknowledge that you have read, understood, and agree to be bound by these Terms and by any documents expressly incorporated by reference (including our Privacy Policy). If you do not agree to these Terms, you must not access or use the Platform.
Your continued use of the Platform after any modification of these Terms constitutes your acceptance of the modified Terms. These Terms apply to all users of the Platform, including individuals seeking mental-health or therapy services ("Patients"), independent practitioners offering such services ("Therapists" or "Providers"), and casual visitors.
The Platform is intended for use by individuals who are at least eighteen (18) years of age. By using the Platform, you represent and warrant that you are at least 18 years old (or the age of legal majority in your jurisdiction, if higher) and that you have the legal capacity to enter into a binding agreement.
Minors. The Platform is not directed to, and may not be used by, individuals under the age of 18 except where a parent or legal guardian is themselves an eligible adult user, has provided verifiable consent in a manner acceptable to Aman and required by applicable law, and agrees to be bound by these Terms on behalf of and together with the minor and to supervise the minor's use of the Platform.
We reserve the right, to the maximum extent permitted by applicable law, to request proof of age, identity, or guardian consent at any time, and to suspend or terminate any account for which such proof is not satisfactorily provided.
Aman is a technology platform only. Aman provides an online matching and discovery platform that enables Patients to search for, discover, view information about, contact, and arrange to engage independent Therapists. Aman's role is limited to facilitating connections and providing the supporting technology, scheduling, and (where applicable) payment-processing tools.
Aman is not a healthcare provider. Aman does not provide, and is not in the business of providing, medical, psychological, psychiatric, counselling, therapeutic, diagnostic, treatment, or any other healthcare services. Aman is not a medical practice, clinic, hospital, healthcare facility, or referral service.
No therapeutic relationship with Aman. No physician–patient, therapist–client, fiduciary, or other professional or care relationship is created between you and Aman by your use of the Platform. Any such relationship, if formed, exists solely between the Patient and the independent Therapist.
Therapists are independent. All Therapists listed on the Platform are independent practitioners. They are not employees, partners, agents, representatives, or contractors of Aman, and Aman does not employ, supervise, direct, or control any Therapist or the manner, methods, timing, or substance of any Therapy Services. Aman does not assign, allocate, or refer specific Patients to specific Therapists.
No responsibility for Therapy Services. To the maximum extent permitted by applicable law, Aman is not responsible or liable for the acts, omissions, advice, conduct, competence, qualifications, diagnoses, treatment, recommendations, statements, or outcomes of any Therapist or for any Therapy Services obtained through the Platform.
Independent selection. Patients independently select their own Therapist. Aman does not choose a Therapist for any Patient and does not operate any clinical "matching engine" that assesses suitability of a particular Therapist for a particular Patient's condition.
No endorsement. Aman does not recommend, endorse, vouch for, rank by quality, refer, or promote any Therapist. The inclusion of a Therapist on the Platform is not an endorsement, certification, or guarantee of that Therapist by Aman. The order, ranking, or prominence in which Therapists or search results are displayed does not constitute a recommendation or endorsement as to the quality, suitability, or fitness of any Therapist.
Your due diligence. You are solely responsible for evaluating, selecting, and verifying the suitability of any Therapist, including by reviewing their stated credentials, asking questions, and exercising your own independent judgment.
Limited, document-based review. Aman may review certain certificates, credentials, or documents that Therapists voluntarily submit. This review is limited in nature and consists only of a review of the documents actually submitted.
No obligation to perform checks. Except as expressly required by applicable law, Aman is under no obligation to, and does not represent that it will, conduct background or criminal-record checks, independently verify the authenticity or continuing status of any licence or credential beyond the documents submitted, confirm a Therapist's professional standing with any regulator, or perform any ongoing monitoring or supervision of any Therapist.
"Verified Therapist" badge. Aman may, in its sole discretion, display a "Verified Therapist" badge in connection with certain Therapist listings, including listings belonging to Therapists who have enrolled in a paid, premium, or membership tier or program. The badge signifies only that the Therapist has met Aman's then-current verification criteria for that badge and/or has joined the relevant program. The badge is not an endorsement, recommendation, referral, ranking, or guarantee of quality, competence, or outcomes, and does not imply that a badged Therapist is superior, more qualified, more suitable, or safer than any Therapist who does not display the badge.
THE PLATFORM IS NOT FOR EMERGENCIES OR CRISES. Aman and the Platform are not designed for, and must not be used in, medical emergencies, psychiatric emergencies, or crisis situations. The Platform does not provide emergency, urgent, or crisis services and cannot dispatch emergency responders.
IF YOU OR ANY OTHER PERSON IS IN DANGER, EXPERIENCING A MEDICAL OR MENTAL-HEALTH EMERGENCY, HAVING THOUGHTS OF SELF-HARM OR SUICIDE, OR AT RISK OF HARMING YOURSELF OR OTHERS, DO NOT USE THE PLATFORM. Instead, immediately call your local emergency services number (for example, 911, 112, 999, or the equivalent in your country), contact a local crisis or suicide-prevention hotline, or go to the nearest emergency room or hospital.
Communications sent through the Platform may not be read or responded to immediately and are not monitored for emergencies.
The Platform, and any content made available by Aman itself (as distinct from content provided by Therapists or other users), is provided for general informational and facilitation purposes only and does not constitute medical, psychological, psychiatric, legal, financial, or other professional advice. Nothing on the Platform is intended to be, or should be used as, a substitute for professional diagnosis, advice, or treatment from a qualified healthcare provider. Any advice, opinion, or information provided by a Therapist is the sole responsibility of that Therapist and does not represent the views of Aman.
Registration. To access certain features, you must create an account and provide accurate, current, and complete information, and keep that information up to date. Accounts may be created using supported sign-in methods (which may include third-party authentication providers); your use of such methods is subject to the applicable third-party terms.
Account security. You are responsible for safeguarding your account credentials and for all activity that occurs under your account. You must notify us promptly of any unauthorized use of your account or any other breach of security.
One account; accurate identity. You agree not to create more than one account except as expressly permitted, not to impersonate any person or entity, and not to misrepresent your identity, role, affiliation, or eligibility.
Suspension and termination. To the maximum extent permitted by applicable law, Aman may suspend, restrict, deactivate, or terminate your account or access to the Platform, in whole or in part, at any time, with or without notice or cause, including for any actual or suspected violation of these Terms. You may stop using the Platform and request closure of your account at any time. Provisions that by their nature should survive termination shall survive.
Independent contractor status. Each Therapist acknowledges and agrees that they are an independent practitioner and not an employee, agent, partner, joint venturer, or representative of Aman. No Therapist has authority to bind or make representations on behalf of Aman.
Licensing and compliance. Each Therapist is solely responsible for holding and maintaining all licences, registrations, certifications, qualifications, and insurance required to lawfully provide Therapy Services in every jurisdiction in which they practice or in which their Patients are located; for complying with all applicable laws, professional standards, codes of conduct, and regulatory requirements; and for determining whether they may lawfully provide services to any particular Patient.
Taxes. Each Therapist is solely responsible for determining, reporting, collecting, remitting, and paying all taxes arising from their provision of Therapy Services and any amounts they receive through or in connection with the Platform.
Accuracy of submitted information. Each Therapist represents and warrants that all information, certificates, credentials, and Content they submit are true, accurate, current, complete, and not misleading, and that they have the right to submit them. Therapists must promptly update any information that becomes inaccurate, including the lapse, suspension, or revocation of any licence or credential.
Responsibility for services. Each Therapist is solely responsible for the Therapy Services they provide, including obtaining informed consent, maintaining appropriate records, safeguarding patient information in accordance with applicable law, carrying appropriate professional indemnity insurance, and managing the clinical relationship with their Patients. Each Therapist agrees to indemnify and hold Aman harmless from any claim arising out of or relating to the Therapy Services they provide.
Aman's model. Aman is a matching and discovery platform and does not charge Patients a separate fee to find, browse, or book Therapists. Instead, Aman earns its revenue through a commission on the fees Therapists charge for services provided through the Platform. The applicable commission rate is disclosed to Therapists before they offer their services and may change from time to time on reasonable notice. Please see our Pricing Plan and Refund & Return Policy for details.
Payment processing. Where payments apply, they may be processed through third-party payment processors. Your use of such processors may be subject to their separate terms and privacy policies, and you authorize Aman and/or its processors to charge your selected payment method for amounts due and to deduct or collect Aman's commission.
Charges for Therapy Services. Each Therapist sets the price (hourly rate) for their own Therapy Services. The Patient pays that rate for the session, and Aman retains its commission on that fee; the Therapist receives the remainder. Aman acts as a limited payment-collection agent or facilitator in connection with these amounts and is not itself the provider of the Therapy Services.
Refunds and dispute handling. Any refund of fees, or of amounts paid for Therapy Services facilitated through the Platform, is subject to the applicable refund policy and time window in effect at the time of purchase. In the event of any dispute, chargeback, or disagreement relating to a payment, fee, charge, booking, cancellation, no-show, or refund, you agree to first raise the matter with us so that we can review it and attempt to resolve it through our internal dispute-resolution process. Nothing in this Section limits any non-waivable right you may have under mandatory consumer-protection or other applicable law, including any right to pursue a chargeback with your card issuer, to dispute a charge before a competent authority, or to any statutory refund or remedy that cannot lawfully be excluded.
Bookings, appointments, cancellations, rescheduling, and no-shows may be subject to the policies presented within the Platform and/or set by individual Therapists. You are responsible for reviewing and complying with the applicable cancellation and rescheduling terms before booking. Aman does not guarantee the availability, punctuality, or attendance of any Therapist or Patient for any booking, and is not responsible for missed, delayed, cancelled, or rescheduled appointments, to the maximum extent permitted by applicable law.
Aman's rights. The Platform and all software, designs, text, graphics, logos, trademarks, service marks, trade names, user interfaces, and other materials provided by Aman (excluding User Content) are owned by or licensed to Aman and are protected by intellectual-property and other laws.
Limited licence to you. Subject to your compliance with these Terms, Aman grants you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Platform for its intended purposes. You may not copy, modify, distribute, sell, lease, reverse-engineer, decompile, or create derivative works of any part of the Platform except as permitted by applicable law that cannot be contractually waived.
User Content licence. You retain ownership of Content you submit. By submitting Content, you grant Aman a worldwide, non-exclusive, royalty-free, sublicensable, and transferable licence to host, store, reproduce, display, adapt, and use such Content as reasonably necessary to operate, provide, improve, secure, and promote the Platform, to the extent permitted by applicable law and our Privacy Policy. You represent and warrant that you have all rights necessary to grant this licence and that your Content does not infringe any third-party rights or violate any law.
Infringement notices. If you believe Content on the Platform infringes your intellectual-property rights, please contact us at support@myamanapp.com with sufficient detail to allow us to investigate.
You agree that you will not, and will not permit or assist any third party to:
Violation of this Section may result in suspension or termination of your account and may expose you to civil and/or criminal liability.
Your use of the Platform is also governed by our Privacy Policy, which is incorporated into these Terms by reference and which describes how we collect, use, disclose, and safeguard personal information. By using the Platform, you consent to the data practices described in the Privacy Policy, to the extent permitted by applicable law. Therapists are independently responsible for their own handling of Patient information in connection with Therapy Services, including compliance with applicable health-privacy, data-protection, and confidentiality laws.
"AS IS" and "AS AVAILABLE". To the maximum extent permitted by applicable law, the Platform and all Content, features, and services are provided on an "AS IS" and "AS AVAILABLE" basis, with all faults and without warranties of any kind. Aman, its affiliates, and its licensors disclaim all warranties, conditions, and representations of any kind, whether express, implied, statutory, or otherwise, including any implied warranties of merchantability, fitness for a particular purpose, title, accuracy, and non-infringement.
No warranty as to users or outcomes. Aman does not warrant that any Therapist is qualified, licensed, competent, safe, or suitable; that any Therapy Services will be effective, safe, or of any particular quality or outcome; that the Platform will be uninterrupted, secure, timely, or error-free; or that the Platform or its servers are free of harmful components. Any reliance on the Platform or on any Therapist is at your own risk.
Jurisdictional limits. Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain statutory rights. Accordingly, some or all of the above exclusions and limitations may not apply to you, and you may have additional rights.
You understand and agree that engaging a Therapist and receiving Therapy Services involves inherent risks, and that the choice of Therapist and the decision to act on any Therapy Services are made by you, the Patient, at your own discretion and risk. To the maximum extent permitted by applicable law, you voluntarily assume all risks associated with your selection of, and interactions with, any Therapist; the Therapy Services you receive; any in-person or remote communications or meetings; and any reliance on information obtained through the Platform. You are responsible for taking reasonable precautions in all interactions with other users.
Exclusion of indirect damages. To the maximum extent permitted by applicable law, in no event shall Aman or its affiliates, officers, directors, employees, agents, contractors, or licensors be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or relating to these Terms or your use of (or inability to use) the Platform, whether based in contract, tort (including negligence), strict liability, or any other legal theory.
Damages relating to Therapists and Therapy Services. To the maximum extent permitted by applicable law, Aman shall not be liable for any damages arising out of or relating to the acts, omissions, advice, conduct, competence, or outcomes of any Therapist, any Therapy Services, any interactions between users, or any content provided by users.
Cap on liability. To the maximum extent permitted by applicable law, the total aggregate liability of Aman and its affiliates for all claims arising out of or relating to these Terms or the Platform shall not exceed the total amount of fees (if any) you actually paid to Aman in the twelve (12) months immediately preceding the event giving rise to the claim.
Jurisdictional limits. Some jurisdictions do not allow the exclusion or limitation of certain damages (including, in some cases, liability for death or personal injury caused by negligence, fraud, or fraudulent misrepresentation). Nothing in these Terms excludes or limits any liability that cannot lawfully be excluded or limited.
To the maximum extent permitted by applicable law, you agree to defend, indemnify, and hold harmless Aman and its affiliates, officers, directors, employees, agents, contractors, and licensors from and against any and all claims, demands, actions, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or relating to: your use of or access to the Platform; your violation of these Terms or any applicable law; your Content or any information you submit; your interactions with, or Therapy Services provided to or by, any other user; and, in the case of a Therapist, the Therapy Services you provide and your professional conduct and compliance.
The Platform is operated and offered globally. By accessing the Platform from any location, you do so on your own initiative and are responsible for compliance with all laws applicable in your jurisdiction, including those governing eligibility to receive or provide Therapy Services, telehealth, professional licensing, consumer protection, taxation, data protection, and export controls. Aman makes no representation that the Platform, or any Therapist or service available through it, is appropriate, lawful, or available for use in every location. These disclaimers are subject always to mandatory local laws (including consumer-protection laws) that cannot be waived or excluded, which continue to apply to you.
These Terms are published, and may be updated from time to time, on the Aman website at myamanapp.com and may also be made available within the Aman mobile application. The Aman website and the Aman mobile application are part of a single, unified Platform and are governed by these same Terms. In the event of any inconsistency between a version of these Terms displayed in one channel and the version published on the website, the version published on the website shall be treated as the controlling version, except to the extent applicable law requires otherwise.
Governing law. These Terms and any dispute or claim arising out of or relating to them, the Platform, or their subject matter shall be governed by and construed in accordance with applicable law, except to the extent that mandatory laws of your country of residence require otherwise.
Informal resolution. Before commencing any formal proceeding, you agree to first contact us at support@myamanapp.com and attempt in good faith to resolve the dispute informally for a reasonable period.
Arbitration (where permitted by law). To the maximum extent permitted by applicable law, any dispute, controversy, or claim arising out of or relating to these Terms or the Platform that is not resolved informally shall be finally resolved by binding arbitration conducted in accordance with applicable arbitration rules. This arbitration agreement does not prevent either party from seeking interim or injunctive relief from a court where available.
Class-action waiver (where permitted by law). To the maximum extent permitted by applicable law, you and Aman agree that each may bring claims against the other only in an individual capacity, and not as a plaintiff or class member in any purported class, collective, consolidated, or representative proceeding.
Mandatory-law carve-out. Nothing in this Section deprives you of the protection of any mandatory provision of the law of your country of residence, including any non-waivable right to bring proceedings in your local courts, to benefit from local consumer-protection laws, or to decline mandatory arbitration where such arbitration or a class-action waiver is not enforceable under applicable law.
Aman may modify, update, or replace these Terms at any time, to the maximum extent permitted by applicable law. When we make material changes, we will take reasonable steps to notify you, such as by posting the updated Terms on the website with a revised "Effective date", and/or by providing notice within the Platform. Changes are effective when posted, unless otherwise stated or unless applicable law requires advance notice or consent. Your continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms.
Severability. If any provision of these Terms is held invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it enforceable or, if it cannot be so modified, severed, and the remaining provisions shall remain in full force and effect.
Entire agreement. These Terms, together with the Privacy Policy and any other documents expressly incorporated by reference, constitute the entire agreement between you and Aman regarding the Platform and supersede all prior or contemporaneous understandings on that subject.
No waiver; assignment. No failure or delay by Aman in exercising any right under these Terms shall constitute a waiver of that right. You may not assign or transfer these Terms without Aman's prior written consent; Aman may freely assign or transfer these Terms, including in connection with a merger, acquisition, reorganization, or sale of assets.
Force majeure. To the maximum extent permitted by applicable law, Aman shall not be liable for any failure or delay in performance caused by events beyond its reasonable control, including acts of God, natural disasters, epidemics, war, terrorism, civil unrest, governmental action, internet or telecommunications failures, or third-party service outages.
Relationship of the parties. Nothing in these Terms creates any partnership, joint venture, agency, fiduciary, or employment relationship between you and Aman.
